1. Acceptance of terms

These Terms and Conditions govern your use of the website, dashboard, and publishing services offered by Brown Fox Press ("we", "us", or "our"). By creating an account, accessing the platform, or purchasing a plan or service, you agree to these Terms.

2. Eligibility and account responsibilities

• You must provide accurate information and keep account credentials secure.
• You are responsible for all activity under your account.
• You must promptly notify us of unauthorized account use.

3. Service scope and delivery

Service inclusions depend on the package or service purchased. Timelines vary based on manuscript readiness, revision rounds, responsiveness, and technical requirements. Estimates are not guarantees unless expressly stated in writing.

We may use platform automation and AI-assisted tooling where helpful, while service delivery may also involve human editorial, design, formatting, production, and support effort.

4. User content and rights

You retain ownership of the original content you submit (including manuscripts and creative assets), subject to any third-party rights.

You grant us a non-exclusive, limited license to host, process, edit, format, reproduce, and otherwise use submitted content solely to provide requested services, maintain the platform, and fulfill contractual obligations.

You represent that you have all rights, permissions, and authority needed for submitted content and that such content does not violate law or third-party rights.

5. Payments, Razorpay, and billing

Prices are shown on the platform or in approved proposals. Payments may be processed through third-party processors, including Razorpay. By purchasing, you authorize charge processing through the available payment methods.

You are responsible for providing valid payment details and for applicable taxes, duties, or bank charges unless explicitly stated otherwise.

6. Refund and cancellation policy

All payments are non-refundable once paid.

Our team allocates resources and begins project planning or execution shortly after purchase. For this reason, once payment is received, cancellations, reversals, or refund claims are not accepted except where non-waivable consumer rights require otherwise under applicable law.

7. Acceptable use

You must not use the Services to:

• Upload or distribute unlawful, infringing, abusive, or malicious content.
• Attempt unauthorized access, reverse engineering, or disruption of systems.
• Use the platform in ways that violate third-party rights or applicable law.

We may suspend or terminate access for violations, security concerns, fraud risks, or legal compliance needs.

8. Content standards, refusal, and takedown rights

We reserve the right, at our sole discretion, to decline, pause, delist, unpublish, or remove any title or project content that appears to:

• Infringe copyright, trademark, privacy, publicity, or other third-party rights.
• Contain plagiarized, copied, or otherwise unauthorized material.
• Include unlawful, defamatory, hateful, extremist, or violent content.
• Promote communal, political, or religious hostility or otherwise present material reasonably likely to create public harm, legal exposure, or serious reputational risk.

If such concerns are identified before or after publication, we may refuse publication or remove the content from distribution without prior notice where needed for safety, legal, or compliance reasons.

No refund will be issued where publication is refused, suspended, or reversed due to infringement, plagiarism, prohibited content, or related policy/legal violations.

9. Intellectual property

The platform, software, brand assets, website design, and related materials are owned by or licensed to Brown Fox Press and protected by intellectual property laws. Except as expressly allowed, you may not copy, modify, distribute, or create derivative works from our proprietary materials.

10. Third-party services and links

Our Services may rely on or link to third-party services (including payment providers, distribution channels, and communication tools). We are not responsible for third-party terms, policies, or performance.

11. Disclaimers

Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted availability, specific publishing outcomes, sales performance, rankings, or commercial success.

12. Limitation of liability

To the maximum extent permitted by law, Brown Fox Press will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities arising from or related to the Services.

Where permitted by law, our total aggregate liability for claims arising out of these Terms or the Services will not exceed the amount you paid to us for the specific service giving rise to the claim.

13. Indemnity

You agree to indemnify and hold harmless Brown Fox Press, its team, and affiliates from claims, losses, liabilities, and expenses arising out of your content, your use of the Services, your breach of these Terms, or your violation of applicable law or third-party rights.
